The old hardware cannot support the new features of ios 4 so it has been cut off at version 3. You may be able to force an upgrade through some jailbreak work arounds, but it will be slow and likely buggy. The first gen iPod is fairly old and apple does an impressive job of keeping old hardware up to date compared to other manufacturers.
