D70 for sure. Some of the lenses won't work on D40 like the 50mm 1.8 (old one), plus D70 has better low light shooting.

I agree. D70. I just sold my D60 because I outgrew it and I couldn't use the AF 50mm f1.8 with it. I upgraded to a used D90. Maybe you should look at the D90.

D70 for sure, The value of the top LCD (D70 has one, D40 does not), and extra hardware buttons cannot be overstated.
