You have to purchase it from Apple using iTunes.

From their Knowledge Base article: "You can purchase the iOS 3.1 Software Update for iPod touch (1st generation) from the iTunes Store using the latest version of iTunes on a Mac or PC."

Go to this website: www.felixbruns.de/iPod/firmware/ its where I get my firmware from. Or you can just update with iTunes. But once you get there, click arrow under iPhone/iPod touch/iPad/apple tv and look for your iPod and click on that firmware and hit download.

What Kwetech1 said. That website has all the firmwares, and it downloads from Apples servers so you know that it's safe.
