I've gone through a couple of these mice. The point of failure is always the mouse ball.
I recently just grabbed a 'like new' magic mouse and love it.
Yeah, I always despised that little ball. It would always get dirty and become clogged and unresponsive. Really annoying!
I've been enjoying the Magic Mouse. For the most part, it works really well. I don't find all the crazy gestures to be very comfortable, but it's easy enough for me to scroll through pages and navigate back and forth through pages in my browser.

While I feel the same way, I was always able to fix a non-scrolling trackball by rolling it around on a sheet of clean, white printer paper. That always worked for me.
