Who else is tired of paying for firmware updates?
This is a topic that still has me baffled, why iPod touch users are still required to pay for major software upgrades whereas iPhone users receive them for free.I can understand the argument that they pay a monthly bill with their carrier, but that isn’t paying for the hardware/software itself, that’s paying for features I don’t receive via my iPod. I personally paid more for my iPod than an iPhone from AT&T EVER cost so why should I have to pay for the software that should be made standard to whomever paid for the product when iPhone users are able to upgrade for free?
iPhone users have their devices with monthly subscription, therefore it is not legally required that apple charge them for updates. Search google, and you'll find out that by law they have to cover the cost of development by charging for updates.
Upgrades are optional, and may not be a great idea if you are still using old (slower) hardware. If I were you I'd wait for hardware update before making the 3.0/3.1 transition.
Also, I doubt you paid more for your ipod than I paid for iPhones, My first one cost $600 plus tax, and my 3rd one cost $700 plus tax. Only my second iPhone, the 3G, was subsidized. Did your ipod cost more than $700? If so you got ripped off big-time, since the highest one has ever retailed for is $499, and they currently max out at $399.

I hear your logic and agree 100%. I'm not sure why one should be required to pay. Apple is already seeing an influx of applications in its store and consumers are already shelling out hundreds of dollars to pay for those; why add an extra cost? You begin to wonder why there are other threads on the forum about whether the 3.0 upgrade was worth it.
Just one quick note for those who own 1st Gen & 2nd Gen iPod Touches:
I paid for the Update for my 2nd Gen Touch, and when I went to update my 1st Gen (I wasn't going to actually pay again, I just felt like stepping through the first few steps 'til it asked for confirmation to pay - plus I didn't have enough left on iTunes Store Account, so it didn't matter) I got my 1st Gen Updated to 3.0 FREE!!
Maybe not huge news, but I was happy to have the same OS on both and not pay any extra. :D
You could also look at it being half the price for each to upgrade. (€4 is an easier pill to swallow).
Hope this benefits anyone who hasn't updated their 1st Gen if they have done with their 2nd Gen.

Really, its up to you whether or not to download iPhone OS 3.0. On a personal note, I updated because Copy & Paste just sold it for me. If you don't like the features included in the new OS, then don't download.

I don't know about you, but if I stayed with 2.2.1 and my apps only worked with OS 3.0, I would be furious.

Yeah, paying for what should have been included features kinda sucks, but at least it's only $10. Does anyone remember when you had to buy a new gadget for hundreds of dollars just because it had new functionality. I always felt this way about the original iPod line up: "What do you mean I can't have the search feature on this iPod?"
That said, I can't imagine that Apple does this simply to fleece people and make more money. Personally, I think people who claim that are ridiculously crazy. An extra $10 per customer wouldn't add that much to their bottom line and their profit margins are already ridiculously huge on these devices.
