Non-rechargeable AA batteries generally have a voltage of 1.5V, while most rechargeable AA batteries (including Apple's) have a voltage of 1.2V. The voltage of all batteries drops as they are discharged and measuring voltage is the cheapest way of measuring battery charge.

The batteries are, in fact, charged fully. Because a fully charged rechargeable battery has a lower voltage than a fully charged non-rechargable battery, the indicated charge is lower than the actual charge. There is no way for Apple to fix this, unless you want to type in the voltage of your batteries every time you change them.

tl;dr: It's not a problem with the batteries; it's a problem with the way your mouse measures the remaining charge.

I realize the voltage characteristics of rechargeable I used them first in flash
guns years ago
what concerns me is the apple batteries dont even register over 50% when
recharged which is a bit of a nightmare so it looks as if I'm heading back to
the alkaline territory

Well, I don't have that problem. I too use Apple's Magic Mouse with Apple's rechargeable batteries and Apple's charger. When I swap the batteries in my mouse for freshly charged ones, my computer indicates that the battery level is about 80%-90%.

My guess is that you have some faulty hardware somewhere.

I also have a new set of these, and after fully charging them, I put them in to my magic mouse, and they register from 57-60% charge.

....my guess you have some faulty hardware - this struck a cord
as I suddenly realized last night that the light on the first charger
was not lighting wonder if they will change a faulty product after all
that time...

went into the store yesterday and they kindly replaced
the faulty item as I had had it four months and only
really used it once

two of the batteries for the keyboard had not charged up
properly which when had an hours charge or so give now
67% so all's ok for now

Another interesting thing: Apple's batteries are apparently rebranded Sanyo Eneloops.
